Employment Discrimination

What is discrimination in the workplace? If you are a member of a "protected class" such as racial or ethnic groups, women and the disabled, it is illegal for an employer to make employment decisions based on the characteristics of that class or because an employee has complained about discrimination. I represent employees who have experienced employment discrimination based on:

  • Race, color or national origin

  • Gender or sex
  • Sexual orientation
  • Pregnancy
  • Leave protected by the Family Medical Leave Act (FMLA)
  • Disability (disabling medical conditions or those an employer believes are disabling)

  • Complaining about discrimination (retaliation)
  • Whistleblowing (reporting certain acts of corporate or government wrongdoing)

Proving employment discrimination is frequently a difficult process, since employers more often than not cover up their discriminatory intent with false allegations. I will work hard to help you expose the lies and prove your employer's true motivation was illegal discrimination.

Harassment in the Workplace

Like discrimination, generally harassment by a supervisor or co-worker must be motivated by a protected characteristic like race or gender for it to be actionable in court. To be actionable, harassment must also be severe or pervasive.
